ANC 3F RESOLUTION

OBJECTING TO APPLICANT’S REQUEST TO MODIFY APPLICATION

ZONING COMMISSION CASE 05-26

           WHEREAS, ANC 3F received a “Request to Modify Application, Zoning Commission Case No. 05-26, 2950 Tilden Street, NW, on Monday afternoon, May 22, 2006; and


           WHEREAS, the applicant requests that the Zoning Commission waive Section 3013.8, authorized by Section 3000, for “good cause,” and


           WHEREAS, the applicant has had numerous meetings with the Office of Planning and the community over many months where numerous concerns were raised, and


           WHEREAS, the applicant’s attorney, Phil Feola, from the firm of Pillsbury Winthrop Shaw Pittman states that “the Zoning Commission’s approval of this waiver will not prejudice the rights of the only party to this application, ANC 3F and that the Applicant presented these new project plans to ANC 3F during an ANC public meeting on May 8, 2006;” and


           WHEREAS, the May 22, 2006, modification does include substantive changes to the plans that were presented to ANC 3F and the community; and


           WHEREAS, the community as a whole and the other “parties” that might be named by the Zoning Commission are not privy to these new plans, nor do they, or the ANC have the ability to ask questions about these new plans prior to the Zoning Commission hearing, and


           WHEREAS, the ANC resolution must be based on the plans presented and the questions and comments received during a public hearing;;


           BE IT RESOLVED, that ANC 3F wants to go on record as objecting to this “Request to Modify Application.”

Approved by a vote of 4-0-0 at a duly noticed public meeting of ANC 3F on May 24, 2006, with a quorum present (a quorum being 4).
