ANC 3F RESOLUTION ON APPLICATION TO OCCUPY PUBLIC SPACE FOR EXISTING OVER HEIGHT FENCE AT 2934 FESSENDEN STREET, N.W. #18182

WHEREAS: in June and/or July 2004, Mr. Robert Nichols constructed a fence at the rear of his lot at 2934 Fessenden Street, N.W. (Square 2272, Lot 851); and
WHEREAS: the fence is located within ANC 3F; and
WHEREAS: the cedar board fence is eight feet high; and
WHEREAS: approximately fifteen feet of the fence was constructed on city owned public space and an additional fifteen feet was constructed between the property line and the building restriction line of Lot 851; and
WHEREAS: the fence completely blocks the sidewalk and tree area on the east side of 30th Street, N.W.; and
WHEREAS: on March 7, 2006, Mr. Nichols filed an application (#18182) for a public space permit in which he states in the description of proposed work “From 30th St. to 30'-0" setback, the 8'-0" fence will be trimmed to lower to 6'-0"h.”; and
WHEREAS: a drawing, dated March 3, 2006, filed with the application indicates that twelve feet of the west end of the fence will be removed and that eighteen feet of the fence will be lowered to six feet; and
THEREFORE, BE IT RESOLVED THAT; ANC 3F recommends and urges that the Public Space Management Administration order that the fence in the fifteen foot public space be removed and that the fifteen feet of the fence between the property line and building restriction line be lowered to no more than six feet high; and
BE IT FURTHER RESOLVED; that the trees and other vegetation in public space north of the fence be removed or trimmed so that they do not interfere with the utility lines serving other properties; and
BE IT FURTHER RESOLVED; that Commissioners Gandhi, Maudlin, Perry and Winstead are designated to represent ANC 3F in this matter before the Public Space Committee.
