SPACE APPLICATION
FOR A SIDEWALK CAFÉ AT IL TESORO
RESTAURANT

WHEREAS, by notice dated June 18,
2004, from the Office of Public Space Management Administration of the
District
Department of Transportation ANC 3F was notified of Application
#04-018, for
year-round rental of public space for the purpose of an Unenclosed
Sidewalk
Cafe, to be rented to Thomas Mott Trustees ET AL, located at 4400
Connecticut
Avenue, NW, in Washington, D.C., adjacent to the premises known as Lot
836,
Square 1971; and
WHEREAS, the application shows that this unenclosed elevated sidewalk café, supported by a two-foot wall, is approximately 740 square feet or 20 feet by 37 feet surrounded by a wrought iron fence, providing for 15 feet of sidewalk between the café’s eastern edge and Connecticut Avenue’s curb edge; and
WHEREAS, this is a very busy commercial section of Connecticut Avenue generating much pedestrian traffic; and
WHEREAS, ANC 3F discussed this unenclosed sidewalk cafe with the lessee and applicant Il Tesoro at the regularly scheduled public meeting of ANC 3F on July 19, 2004; and
WHEREAS, Il Tesoro has agreed to make certain changes to the sidewalk café.
BE IT RESOLVED, that the ANC does not object to the issuance of a
public
space permit for an unenclosed sidewalk cafe at 4400 Connecticut
Avenue, NW
provided that:
1. The café has no more than 14 tables and 28 chairs.
2. At a minimum the cafe is appropriately screened on three sides from the sidewalk by six planter boxes hung from the wrought iron fence. Each box shall also contain flowers and trailing plants. The two dwarf trees shall be maintained in the outdoor café area. The brick enclosed planter box to the right of the stairs to the restaurant shall be kept attractive with flowers and other plantings that remain green throughout the year. The applicant shall replace plants that are damaged, die, or are stolen immediately upon discovery.
3. The fence’s uprights shall be repaired so that there are no broken fleur-de-lis tops on any of the poles.
4. The fence is repainted every year.

Approved by a vote of 6-0-1 at a duly noticed public meeting on July 19, 2004, with a quorum present.
