ANC3F RESOLUTION SUPPORTING AN APPEAL TO THE BOARD OF ZONING ADJUSTMENT
FROM THE ISSUANCE BY DCRA OF CONSTRUCTION PERMITS B446316 AND B446312,
2900 AND 2902 ALBEMARLE STREET NW

WHEREAS:  The Department of Consumer and Regulatory Affairs (DCRA) issued construction permits B446316, 2900 Albemarle Street NW, and B446312, 2902 Albemarle Street NW, on June 13, 2002; and

WHEREAS:  DCRA denied ANC 3F the statutorily required 30 days to review the application for these permits; and

WHEREAS:  DCRA failed to make available to ANC 3F the application and supporting documentation for these permits; and

WHEREAS:  In denying ANC 3F the 30 day review and in failing to provide documentation to ANC 3F supporting the application for permits B446316 and B446312, DCRA also denied to ANC 3F the statutorily granted right to have its views receive “great weight” in the decision to issue these  permits; and

WHEREAS:  There is evidence that the applications for permits B446316 and B446312 were incomplete and did not meet the requirements governing such applications.

THEREFORE BE IT RESOLVED THAT: ANC 3F should join the appeal of Brendan Herron of 2901 Albemarle Street NW to the Board of Zoning Adjustment (BZA) in order to request that the BZA direct that permits B446316 and B446312 be revoked, that a stop work order be immediately issued, and that before any work may proceed at the subdivided 2900 Albemarle Street site new applications be submitted that comply with existing zoning regulations and that DCRA meet the requirement for notice and “great weight”.
