ANC3F RESOLUTION REGARDING CONSTRUCTION PERMIT
 ISSUED FOR 5105 LINNEAN AVENUE, N.W.

WHEREAS, on May 2, 2002,  K Services Ltd. Co. filed an application for a building permit for  additions to and alteration of a structure at 5105 Linnean Avenue, N.W., (Square 2282 Lot 2), and

WHEREAS, on July 16, 2002, The DC Department of Consumer and Regulatory Affairs issued Building Permit No. 447157 for the proposed work, and

WHEREAS, on April 5, 2002, The Forest Hills Citizens Association filed a petition with the DC Zoning Commission for a Forest Hills Tree and Slope Protection Overlay District (FHTSPOD), ZC Case No. 02-19, and

WHEREAS, on April 19, 2002, the DC Zoning Commission set down the FHTSPOD and it vested on that date, and

WHEREAS, Section 1520.6 Title 11 DCMR includes Square 2282 in the FHTSPOD, and

WHEREAS, Section 107.15.6 Title 12A DCMR provides that the applicant for a building permit will provide the Zoning Division of DCRA with “Other information necessary to determine compliance with  Title 11 DCMR, Zoning Regulations.”, and

WHEREAS, it appears that incorrect information was filed contrary to the requirements of Section 107.15.6 Title 12A DCMR, the purpose of which is to determine whether the application is in compliance with the FHTSPOD.

THEREFORE, BE IT RESOLVED, that ANC3F requests that DCRA immediately suspend construction at the site until the permittee files the required information, a copy is made available to ANC3F, and DCRA reviews the information and determines whether the permittee is in compliance with the FHTSPOD.

Adopted by a vote of 7-0-0 at a duly noticed public meeting of ANC 3F, with a quorum present, on September 17, 2002.
