WHEREAS, by notice dated April 25, 2002 (envelope dated May 1,
2002), from the Permit Service Center of the Building and Land Regulation
Administration, ANC 3F was notified of Application #02-021, for rental
of public space for the purpose of an Unenclosed Sidewalk Cafe, to be rented
to Saul Subsidiary II, LP, located at 4455 Connecticut Avenue, NW, in Washington,
D.C., adjacent to the premises known as Lot 0803, Square 2046; and
WHEREAS, the application shows that this unenclosed sidewalk
cafe is for Delhi Dhaba, Inc., the lessee, and that the drawings, prepared
by Jane Nelson, Nelson Architects, are for a cafe of 610.5 square feet,
29’6 feet by 21 feet, surrounded by rope and stanchion, providing for 14
feet of sidewalk between the cafe and Connecticut Avenue; and
WHEREAS, this is a very busy commercial section of Connecticut
Avenue generating much pedestrian traffic; and
WHEREAS, ANC 3F has heard from many constituents that they are opposed
to sidewalk cafes that occupy much of the sidewalk space and that are not
attractively screened by plantings from pedestrian and vehicular view;
and
WHEREAS, the drawing submitted with the public space request shows
10 tables with 4 seats each, arranged in 3 rows; and
WHEREAS, ANC 3F is aware of, and shares the concern expressed to the
Public Space Committee by Pepco regarding the two underground electrical
manholes located in row 2 of the drawing, within the area of the unenclosed
sidewalk cafe; and
WHEREAS, ANC 3F discussed this unenclosed sidewalk cafe with the lessee
and applicant Delhi Dhaba at the regularly scheduled public meeting of
ANC 3F on May 20, 2002; and
WHEREAS, Delhi Dhaba has agreed to make changes to the sidewalk cafe,
BE IT RESOLVED, that ANC does not object to the issuance of a public
space permit for an unenclosed sidewalk cafe at 4455 Connecticut Avenue,
provided that:
1. The cafe is appropriately screened on all sides from the sidewalk
by planter vases/boxes and plants and not by rope and stanchions.
2. The applicant decrease the size of the cafe to 29’6 feet by 17 feet.
3. The Pepco concern regarding access to the manholes can satisfactorily
be addressed, along with the safety concerns for patrons at tables in the
vicinity of these manhole covers.
BE IT FURTHER RESOLVED, that Commissioners Karen Perry, Cathy Wiss and/or
David Bardin represent the views of ANC 3F on this application at the Public
Space Committee meeting.
Approved by a vote of 6-0-0 at a duly noticed public meeting on May 20, 2002, with a quorum present.
