ANC 3F RESOLUTION REGARDING A PUBLIC SPACE APPLICATION
FOR A SIDEWALK CAFÉ
AT THE CHIPOTLE RESTAURANT
AT 4301 WISCONSIN AVENUE, N.W.

WHEREAS:representatives
of the Chipotle Restaurant appeared at an ANC 3F meeting on November 19,
2001, with a request to open a sidewalk cafe at their Tenleytown location,
4301 Wisconsin Avenue, N.W., which is located in ANC 3F06; and
WHEREAS:at
that meeting ANC 3F asked Chipotle to modify the plans for the cafe because
of neighborhood concerns about:
-insufficient
space between the driveway and cafe for the safety of diners;
-increase
in litter along Wisconsin Avenue and nearby neighborhood streets;
-increase
in noise level and traffic;
-inadequate
fencing or buffering around the cafe;
-lack
of a promised landscaping plan;
-difficulty
of supervising the liquor license at the unattended café; and
WHEREAS:Chipotle
has revised the plans to:
-move
the café back six feet from the driveway to minimize the potential
of cars driving into the café;
-install
three trash receptacles around the cafe, one next to the building and two
along the sidewalk for the disposal of litter;
-limit
potential for noise by reducing the number of tables from six to five and
the number of seats from 22 to 18 and by agreeing not to pipe music outside;
-provide
a fence of rope and stanchion as well as landscaping in the 6 foot wide
strip between the driveway and café and in a 2'6" wide strip between
the sidewalk and café to buffer the cafe and enhance its appearance;
and
-not
serve alcoholic beverages at the café; and
WHEREAS:the trash receptacles
proposed to surround the café are 30” wide and over 7 feet tall;
and
WHEREAS:the two trash
receptacles on public space, planned to be placed adjacent to the public
sidewalk and only ten feet from Wisconsin Avenue, would tower above the
tables and chairs, fencing and landscaping around the café, which
are limited to a maximum of three feet, and would intrude visually on the
streetscape; and
WHEREAS:the trash receptacle
at the juncture of the driveway and sidewalk would be a safety hazard because
it would block visibility of pedestrians for cars exiting the driveway;
and
WHEREAS:neither trash
receptacle next to the sidewalk would be accessible to diners at the café
because they are too far outside the fencing to the café and face
away from the cafe;
THEREFORE BE IT RESOLVED THAT:ANC
3F recommends approval of the sidewalk café in public space on the
condition that no very tall trash receptacles be installed next to the
public sidewalk, but that an additional trash receptacle be provided on
private property next to the building, as indicated in the attached diagram.
Approved by a vote of 6-0-1 at a duly noticed public
meeting on January 13, 2003, with a quorum present.
